Corporations & The Constitutional Law

All laws fall under the Constitutional law and corporation laws are so vastly different in each state that it was considered unimportant.

By-laws contain the methods of managing the corporation. It is here that one will find a preamble on the Directors Code of Conduct (or Ethics) rules. A code of ethics sets down the positive standards of behavior in the over all management and is written to assure the public that they are committed to the well being of the corporation.

White collar crimes are committed mostly by the affluent during the course of business activities and is a violation of the social relationship of trust. Corporate crimes fall into various activities such as ;

– fraud – embezzlement

– corruption – bribery

– tax fraud/evasion – stock manipulation

– insider trading – misrepresentation of advertising

– restraint of trade – infringement of patents

The costs of corporate crimes is said to be greater than that of all street crimes combined and yet the least punished by law. They will receive a slap on the wrist, small fine, pay restitution or a suspended sentence but never get jail whereas a street criminal committing a $100.00 robbery would face prison. Why is the system set up in this manner?

A corporate fraud is very complex and difficult to unravel with the existing laws. Local police officers are trained to handle street crimes and federal agencies will only address corporate crimes over a specified amount and the Supreme Court must uphold Constitutional law.

Abusive financial behaviors such as bribery, kick backs and pay- offs in the construction industry hiked prices up 10-50% with taxpayers getting overcharged $2 billion dollars yearly. Banks and loans offices cost billions of dollars with their collapse. Colleges and universities have also been found to abuse their grant monies and health facilities committing their fair share of theft.

The American people can contact their state government officials or contact the White House blog (URL available at end) to have your voices heard. Canadians can contact the Justice Department or their own government officials. A positive change can occur if it starts from the top and they enforce others to be honest role models, as they are entrusted by the People.

I liked this the point about why the corporate crime is not dealt with so strictly; "Local police officers are trained to handle street crimes". One more reason that I feel could be is, usually this corporate crime are done not by individual but by the corporate itself which in turn pays the government a huge tax. Hence, while punishing them the law goes soft over them thinking about the tax lose that has to be faced if the punishment goes too strict.
